General Sales Terms and Conditions 

Article 1 – Introduction

The seller is HORSIFY SPRL, a company with a working capital of 50.000 euros, with a head office located at 38 rue de Colinet, B-1380 Lasne, Belgium (telephone number +32 (0) 497.55 .54.07, sales@horsify.be) declared under the VAT number BE 0545 902 736.

The buyer is the party who as an individual, or as a company, accepts these terms and conditions. The buyer, whether in his own name or as a signatory of a company, claims to have reached majority in the country from which it makes the purchase and to be responsible for its purchase.

General sales terms apply exclusively to all sales made by HORSIFY both on its own behalf and on behalf of its subcontractors. All other conditions engage the seller only after written confirmation of its liability. The mere fact of placing an order or accepting an offer from HORSIFY implies the unconditional acceptance of these terms. These terms and conditions may be changed at any time without notice by HORSIFY, the changes are then applied to all subsequent orders or offers.

 

Article 2 – Personal data and privacy

When recording personal data to create an account on HORSIFY’s website, the buyer must ensure the accuracy and completeness of data submitted. In case of error of the recipient's details, HORSIFY cannot be held responsible for failure to deliver the product. HORSIFY reserves the right to cancel any order if the IP address of the buyer emanates from a country different to the billing and / or delivery address.

The buyer shall in no case transfer its email address nor password to a third party. The buyer is responsible for use of his account on HORSIFY’s website. Should he be made aware of or become suspicious of inappropriate use of his information, it is up to the buyer to promptly notify HORSIFY which can block or disable the account and, depending on the circumstances of the breach of security, may allow the creation of a new account.

Personal information will only be used to process orders and contact the buyer as necessary. HORSIFY may periodically inform the buyer about promotions, new products or clearances that may be of interest. The buyer has the opportunity upon receipt of the first message to decline any further notifications by asking by return message.

The buyer has the right to access, modify, rectify, and delete his personal data. HORSIFY undertakes not to divulge the coordinates of its customers to third parties without prior consent, whether free or against payment.

 

Article 3  - Products and Prices

HORSIFY strives to provide the most accurate descriptions, specifications and illustrations of the items offered. However, they are not binding and are intended only to give a general description of products. HORSIFY can in no way be held responsible for errors or omissions.

The information contained in catalogues, prices, websites, notes, etc. are indicative only and may as such be changed by the seller without notice with the understanding that these amendments will have no impact on the obligations of the parties relating to orders previously confirmed by HORSIFY.

HORSIFY can in no case be held responsible for incorrect or irresponsible use of its products. In addition, HORSIFY can in no way be held responsible for any physical or material damage caused to third parties or to a horse following an illegal and / or improper use of products purchased on the website.

Prices include VAT and are in Euros, per unit of product, and are non inclusive of the cost of processing, shipping, transportation and delivery fees, as detailed in the section entitled deliveries.

Companies and / or individuals with a valid VAT number may apply to receive an invoice. This option is included in the purchasing process.

The seller undertakes to monitor stock levels. However, it may happen that an article purchased is no longer available at the time of the transaction. HORSIFY will inform the buyer at the latest within 2 working days of its purchase and will either offer an alternative product, or a new delivery date for the item and the order in question, or either a refund of all or part of its order, depending if the buyer agrees to be partially delivered or not.

It is up to the buyer to check with the local authority of its country for any import or order limitations for the products he intends to purchase.

 

Article 4 – Delivery

HORSIFY undertakes to ensure that the order is delivered promptly.

Any order placed on the website is processed the next working day or at the latest the following working day.

Once the order is processed and verification of the availability of the stock is complete, the order is prepared and transmitted to the carrier or a collection point the same working day, or next working day at the latest.

Delivery fees are charged at the rates shown on HORSIFY’s website on the date of the order and based on the size of the order and the shipping method chosen. 

The product is delivered to the billing address unless otherwise specified in the boxes provided for this purpose when placing the order. In case of incomplete or wrong shipping address provided by the buyer, the new shipment at the corrected address will be charged in addition to the order.

          The delivery services of Bpost are valid for deliveries in Belgium and abroad.

          Delivery is estimated at

          - 1 to 2 working days for Belgium

          - 2 to 5 days for rest of Europe

          Delivery times quoted are average times and are mentioned for information only and are not legally binding.

          Any failure to deliver or delay of more than 8 working days must be reported to HORSIFY by email.

The buyer shall provide a valid shipping address where someone he trusts will be able to sign receipt of the parcel.

The buyer cannot claim compensation in case of late delivery by the carrier or by the Bpost services. 

HORSIFY supports transportation risks until delivery, that is to say, until physical delivery of the goods to the consignee indicated at the time of the order or its representative who accepts, providing he has verified the goods upon receipt in the presence of the carrier and who has, if applicable, notified in writing on the transport document any discrepancies observed.

The buyer shall refuse delivery if the goods are damaged, missing or if the package has been opened or tampered with and must notify in writing on the transport document any discrepancies observed. A copy of the transport document must be forwarded as soon as possible by email or mail to HORSIFY.

 

Article 5  - Payments

The following online methods of payment are available to the buyer :

- Credit Card (Visa, MasterCard, American Express)

- Debit card (Bancontact / Mister Cash, ING HomePay, Belfius Direct Net)

- The secure payment system PayPal

- Gift voucher

- Bank transfer

 HORSIFY has no access to data for the payment by the buyer. Payment is made directly into the hands of the bank or financial institution.

The buyer who places an order with a representative of HORSIFY without going through the website can make his payment by bank transfer. The buyer who takes his order at HORSIFY’s showroom on appointment can pay in cash or by bank transfer.

All orders will be processed and delivered only when the amounts due are settled with HORSIFY.

 

Article 6 – Order cancelations and returns

Pursuant to the Belgian Law of 14 July 1991 on trade practices and consumer protection and information, the buyer has a period of 7 working days from the day after the date of delivery of the order, to notify Horsify that he waives his purchase in whole or in part.

This right of cancellation does not apply to the professional buyer but only to consumers as individuals. 

For customized products, the buyer is not entitled to this right.

The right of renunciation is subject to the buyer returning the items subject to cancellation within 5 working days from the notification by registered mail of the cancellation.

Returned products must be shipped in the same condition, in their original packaging and in perfect condition. They must be accompanied by their delivery note or invoice. Return costs are borne by the buyer.

In case of cancellation of the order, Horsify will refund the buyer within 30 working days after receiving the goods up to the price of the items, but will not refund shipping costs.

To return the goods subject to cancellation, the buyer can

- Return them in person to HORSIFY’s showroom (by appointment only)

          - Ask for a return label to apply to the parcel to return. The buyer must deposit the parcel at a Bpost collection point.

- Use a reliable delivery service because HORSIFY can never be held responsible for the loss of goods during transportation. Packages returned without postage or insufficient postage will be refused and returned to sender.

Horsify reserves the right to refuse returned items or not to reimburse if they were damaged by the buyer or his horse, used or whashed, or if the original packaging was opened.

In case of delivery of faulty, damaged or a mistakenly delivered goods, the buyer must contact HORSIFY by email at admin@horsify.be. HORSIFY will arrange the return shipment of the faulty, damaged, or mistakenly delivered goods and will bear the costs.

Returned products must be shipped in the same condition, in their original packaging and in perfect condition. They must be accompanied by the delivery note or invoice.

Article 8 – Intellectual property

All elements of HORSIFY’s website and underlying technology are protected by copyright, trademarks or registered trademarks laws and are protected by intellectual property rights.

Any third party that wishes to place on its website a direct link to HORSIFY’s website must request permission from HORSIFY.

 

Article 9 – Applicable law

These terms and conditions as well as the use of HORSIFY’s website are governed by Belgian law. The buyer agrees that any legal action arising from the use of the website or the conclusion, validity, interpretation and execution of the sales contracts or these general conditions shall be filed only before the Courts of Nivelles (Belgium) and expressly agrees to submit to the jurisdiction of such courts for the purposes of such action.
